A 61-year-old Mountain View County woman has been ordered to stand trial in the shooting death of her husband 15 months ago.

Heather Wilson Duncan faces a charge of second degree murder in the death of Barry Alexander Duncan, 68, who was found deceased in the couple’s rural home south of Bergen on Dec. 10, 2010.

Heather Duncan’s preliminary hearing was held in Didsbury provincial court on March 27 and 28 before Judge George Gaschner. A publication ban prohibits reporting on testimony and evidence presented at the hearing.

Duncan, who has elected to be tried by judge and jury in Court of Queen’s Bench, will have her trial date set on May 25.

In an interview following court, Duncan’s lawyer, Jim Butlin, said he argued that his client should have been committed for trial on a charge of manslaughter, but the judge disagreed.

“She (Duncan) is very pleased that there is going to be a trial date set in the foreseeable future,” he said.

Duncan remains out on bail pending the trial.
